ZIG-ZAG® #ZIGZAGFORLIFE TATTOO PROMOTION CONSENT AND RELEASE

By participating in the Zig-Zag® #ZigZagforLife Tattoo Promotion (“Promotion”), you (“Participant”) agree to the following terms and conditions:

1. Eligibility

  • You confirm you are 21 years of age or older at the time of entry.
  • You are a legal resident of the United States.
  • A maximum of 800 individuals may enter the campaign; entries will be accepted on a first-come, first-served basis until this limit is reached. Order of entries will be determined by order of submissions received.

2. How to Enter

To participate, you must:
a) Have or have recently received a Zig-Zag® branded tattoo, defined as:

i. The Zig-Zag® logo;
ii. A Zig-Zag® branded product;
iii. Or “Boris” (Zig-Zag’s iconic brand character).

b) Post a clear image or video of the tattoo to a public social media account
c) Use the official campaign hashtag: #ZigZagforLife in the post.
d) Follow Zig-Zag Social Pages- Zig-Zag World (@zigzagworld), Zig-Zag Wraps (@zigzag_wrap), Zig-Zag Supply (@zigzagsupply)
e) Submit proof of post and tattoo to Zig-Zag® via the designated website
f) Not denigrate, disparage, tarnish, present in a false light, or otherwise reflect negatively on the Zig-Zag trademarks

3. Tattoo Disclosure

  • You affirm that the tattoo was obtained voluntarily and was not paid for, reimbursed, or otherwise incentivized by Zig-Zag®, its affiliates, or agents.
  • You understand that submitting an image of your tattoo does not guarantee participation approval or prize receipt, which is at Zig-Zag’s sole discretion and subject to eligibility requirements.

4. Lifetime Supply Definition

  • “Lifetime supply of cones” is defined as 9,600 total Zig-Zag® cone units.
  • Selected campaign participants will receive two (2) cases of Zig-Zag® Bulk Paper Cones,chosen from the following products and subject to availability and while supplies last: UT 1¼ 900CT BT, UB 1¼ 900CT BT, UT King 800CT BT, or UB King 800CT BT.
  • Cones will be delivered in scheduled shipments, batches, or allotments at Zig-Zag®’s discretion.

5. Consent to Use of Image and Content

  • By submitting your tattoo and post, you grant Zig-Zag®, its affiliates, licensees, and agents the right to use your name, image, likeness, social media handle, submitted content, and tattoo image in connection with marketing, advertising, promotion, publicity, or other commercial purposes in perpetuity, worldwide, and in any media now known or later developed, without further compensation, notice, or approval.

6. Release of Liability

  • By participating in the Promotion, you agree to release and hold harmless National Tobacco Company, L.P. , its parent company, affiliates, officers, employees, agents, and promotional partners (collectively, the “Company”) from any and all claims, damages, liabilities, costs, or expenses arising out of or related to your participation in the Promotion. This includes, without limitation, any issues associated with your decision to receive a tattoo, the tattoo procedure itself, any resulting health complications or adverse events arising from your tattoo, or your use of the product prize.
  • You acknowledge and accept that receiving a tattoo carries inherent risks, including but not limited to infection, allergic reactions, scarring, or other medical complications. You voluntarily assume all such risks and waive any right to assert a claim against National Tobacco Company, L.P. or its affiliates, employees, agents, or partners for any injury or health issue that may result, including those arising from unsafe, unregulated, or non-standard tattoo practices.

7. Additional Terms

  • Participation is subject to verification and compliance with all terms outlined herein.
  • All product received by this Promotion is for personal use only. Re-sale is expressly prohibited.
  • Zig-Zag® reserves the right to deny entry, disqualify participants, or revoke product distribution for any reason, including false or misleading information or inappropriate content.
  • Age Verification Requirement: Prior to awarding or shipping any prize, all participants must undergo age verification to confirm eligibility. Failure to provide valid proof of legal age will result in disqualification and forfeiture of the prize.
    Promotion is void where prohibited.
  • State Eligibility Restrictions: Due to state laws and regulations, this promotion is not valid for residents of Alabama, Arizona, Arkansas, Louisiana, Maine, Maryland, Missouri, Rhode Island, or Vermont. We are unable to ship product prizes to these states, and participation from residents of these states is therefore not permitted.
  • Under no circumstances shall Participant be considered an employee. This Promotion shall not be construed to create any association, partnership, joint venture, employment, or agency relationship between you and the Company for any purpose. You have no authority (and shall not hold yourself out as having authority) to bind the Company and you shall not make any agreements or representations on the Company's behalf without the Company's prior written
    consent.
  • Any controversy or claim arising out of or relating to this Promotion, contract, or the breach thereof, shall be settled confidentially by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
  • This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky.

BY PARTICIPATING IN THIS PROMOTION, YOU ACKNOWLEDGE YOU HAVE READ,
UNDERSTAND, AND AGREE TO THIS CONSENT AND RELEASE FORM.
